Just in case there weren't enough cooks in the kitchen, now the CEQA reform discussions will take some pit stops at the Historic Preservation Commission and Planning Commission. After Supervisor Kim proposed her competing CEQA legislation, Board President Chiu amended Supervisor Wiener's original proposal - are you still following? Both versions were amended to provide for an appeal process of a Planning Department determination that an exempt project modification does not require a new decision under CEQA. In Kim's version the appeal would go to the Planning Commission, in Chiu's version it would go to the Environmental Review Officer, and in a third option the Planning Department staff recommends that instead of an appeal hearing, a procedure would be established that would provide for a written reconsideration by the Environmental Review Officer. Man oh man, this just gets even more complicated every day.
