Preservation Commissioner Can't Be Booted

A group of preservationists have been trying to get one of the preservation commission members booted from his seat, claiming he's legally unqualified because he's not a professional historian. Unfortunately for them, the First District Court of Appeal said Thursday that only the state attorney general can sue to challenge an office-holder's qualifications, not private citizens. Attorney General Kamala Harris has decided not to go after Commissioner Richard Harris, due to the justification that "reasonable minds may differ on whether he meets the law's criteria". According to the City Insider, the opponents can now sue Harris...for refusing to sue. They'd have to prove that her decision was an "abuse of discretion,'' which is a pretty tough sell.
